Terms of Service

Independent software. JD3 ZoneTools is developed and sold by JD3 Lasers LLC. It is not affiliated with, endorsed by, or sponsored by Pangolin Laser Systems, Inc. Pangolin® and BEYOND® are registered trademarks of Pangolin Laser Systems, Inc. All rights reserved by their respective owners.

1. Acceptance of Terms

By installing or using JD3 ZoneTools ("the Software"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the Software.

These Terms are between you and JD3 Lasers LLC, a Texas limited liability company ("JD3 Lasers," "we," "us," or "our").

2. License Grant

Subject to these Terms and payment of the applicable license fee, JD3 Lasers grants you a non-exclusive, perpetual license to install and use the Software as follows, per license purchased:

  • up to two BEYOND machines
  • up to three concurrent activations, covering those machines plus one spare
  • unlimited remote operator sessions joining those machines

You may not sublicense, sell, resell, or share your license, and license keys are issued per purchaser. You may transfer a license to another party with our prior written consent, which we do not charge for and do not unreasonably withhold. Email us to arrange it.

3. Beta Software

JD3 ZoneTools is in closed beta. Beta software may contain bugs and may change between versions. By using the beta you accept that:

  • features, pricing, and behavior may change before general release
  • the Software may be less stable than a final release
  • your feedback may be used to improve the product
  • beta access may be revoked at our discretion

4. Third-Party Software Compatibility

JD3 ZoneTools interoperates with Pangolin BEYOND® via its published network protocols (Talk TCP, OSC). This is best-effort. We don't warrant that the Software will remain compatible with any version of BEYOND or any other third-party software.

5. Safety Responsibilities

JD3 ZoneTools is a control and management tool, not a laser-safety device or a safety-certified system. You are solely responsible for operating your laser equipment safely and in compliance with all applicable laws, regulations, and venue requirements, including any audience-scanning and laser-safety rules. Always use appropriate independent hardware safety measures, such as scan-fail safeguards and emergency stops, that do not depend on the Software.

6. Restrictions

You may not:

  • reverse engineer, decompile, disassemble, or otherwise derive source code from the Software
  • modify, adapt, translate, or create derivative works based on the Software
  • remove or alter proprietary notices, labels, or marks
  • use the Software for unlawful purposes
  • circumvent license enforcement or share activation credentials

7. Updates and Support

Your license includes free updates within the major version you bought. We may change the update policy with reasonable notice.

Support is provided on a best-effort basis via email. Response times are not guaranteed.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JD3 LASERS EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

JD3 Lasers does not warrant that the Software will be error-free, uninterrupted, or free from harmful components, or that defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JD3 LASERS LLC, ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL JD3 LASERS' TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU FOR THE LICENSE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) US$100. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

10. Termination

These Terms run until terminated. Your license terminates automatically if you breach any provision. On termination, stop using the Software and destroy all copies in your possession.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Disputes are resolved in the courts of Harris County, Texas.
